A rental replacement permit is required when a proposed redevelopment results in the demolition or conversion of six or more dwelling units. The applicant is required to replace the rental units and provide compensation to tenants.

A Planning Act application must accompany applications for rental replacement permits.  Applicants looking to submit a Planning Act application with a rental replacement permit application need to request a pre-submission consultation before they apply.

Filing an application

After you finish the pre-submission process, you can file a complete application for a rental replacement permit. A rental replacement permit is required any time an applicant submits an application under the Planning Act that will result in the demolition or conversion of six or more rental units. The bylaw applies to applications relating to multiple properties containing six or more units together.

For a permit to be issued, the applicant must submit documentation showing plans in the related planning application to replace the demolished or converted rental units and documentation of the compensation provided to tenants displaced by the application's approval.

After you apply

For the rental replacement permit to be issued, the applicant must work with City staff to provide documentation of the compensation provided to displaced tenants and the provision of replacement rental units in the new development. 

A member of the Development and Housing Approvals team will review the documentation, and the Director of Development and Housing Approvals will make a decision. At their discretion, the director may refer the approval of the rental replacement permit application to Kitchener City Council. 

Staff aim to reach a decision on rental replacement permit applications at the same time it takes to reach a decision on the related planning application.
