COMMITTEE OF ADJUSTMENT - CITY OF KITCHENER
(Pursuant to the Planning Act, R.S.O. 1990, c.P. 13, as amended,
and Ontario Regulations 197/96 and 200/96, as amended)
TAKE NOTICE THAT the Committee of Adjustment for the City of Kitchener will meet in Council Chambers, 2nd Floor, Kitchener City Hall, 200 King Street West, on TUESDAY, JUNE 16, 2026, commencing at 10:00 a.m. for the purpose of hearing the following applications for Minor Variance and/or Consent. Applicants or Agents must attend in support of the application. This is a public meeting. Anyone who has an interest in any of these applications may make oral submission at the meeting or provide a written submission for Committee consideration. Please note, this is a public meeting and will be livestreamed and archived at www.kitchener.ca/watchnow.
APPLICATIONS FOR MINOR VARIANCE AND / OR CONSENT PURSUANT TO THE PLANNING ACT
A 2026-036 - 44-50 Arlington Boulevard
Requesting a minor variance to permit a Floor Space Ratio of 0.95 rather than the maximum permitted 0.84 to facilitate a stacked townhouse development having 16 dwelling units in accordance with Site Plan Application SPF26/010/A.
A 2026-037 - 63 Courtland Avenue East
Requesting minor variances to add a ‘Cluster Townhouse Dwelling’ as a permitted use; to permit a front yard setback of 0m (Courtland Avenue East for Building B) rather than the minimum required 4.5m; to permit an easterly side yard setback of 1.5m (for Building E) rather than the minimum required 2.5m; to permit a rear yard setback of 1.6m (Martin Street for Buildings E, F and G) rather than the minimum required 4.0m; and, to permit a building length of 40m (for Building D) rather than the maximum permitted 36m to facilitate the development of the property with five stacked townhouse buildings having 70 dwelling units and one cluster townhouse building having 4 dwelling units in accordance with Site Plan Application SPF25/090/C.
A 2026-038 - 711 Westmount Road West
Requesting minor variances to permit a lot area of 790sq.m. rather than the minimum required 929sq.m.; to permit a corner lot width of 21.9m rather than the minimum required 24m; and, to permit a westerly interior side yard setback of 1.3m rather than the minimum required 3m to facilitate the construction of an Additional Dwelling Unit (ADU)(Detached) in the rear yard of the subject property.
A 2026-039 - 193 Strange Street
Requesting minor variances to permit a ‘Personal Service’ Home Occupation in a Single Detached Dwelling on a lot with two ADUs (Detached) whereas this home occupation is only permitted on a lot with a Single Detached Dwelling; to permit a driveway width of 5.2m (43% of the lot width) rather than the maximum permitted 4.8m (40% of the lot width); to permit a ‘Personal Service’ Home Occupation to have a Gross Floor Area (GFA) of 19.5sq.m. rather than the maximum permitted 15sq.m.; and, to permit a lot width of 12.1m rather than the minimum required 12.8m to facilitate the construction of a Detached ADU with two dwelling units in the rear yard of the subject property.
B 2026-007 - 104 Woodpoppy Court & 192 Grey Fox Drive
Requesting consent to sever a lot containing a Semi-Detached Dwelling that has inadvertently merged on title so that each half may be dealt with independently. The severed land, 192 Grey Fox Drive will have a width of 12.5m on Woodpoppy Court, a depth of 34.4m and an area of 508.4sq.m. The retained land, 104 Woodpoppy Court will have a width of 7.5m on Woodpoppy Court, a depth of 34.4m and an area of 258.2sq.m. Consent is also being requested to create an easement over 192 Grey Fox Drive having a width of 1.5m, a depth of 5m and an area of 7.5sq.m. in favour of 104 Woodpoppy Court, to facilitate a maintenance easement.
B 2026-008 - 12 Onward Avenue
Requesting consent to create an easement over the parcels described as Parts 2 and 3 on the Draft Reference Plan submitted with the application in favour of the abutting property municipally addressed as 16 Onward Avenue, for the purpose of facilitating a historical encroachment of the driveway and detached garage and to permit shared driveway access and right of way. The parcel described as Part 2 will have a width of 1.39m, a depth of 18.1m and an area of 22.7sq.m; Part 3 being triangular in shape will have a width of 0.45m, a depth of 5.7m and an area of 2sq.m.

· Anyone who has an interest in any of these applications may attend this meeting.
· Only the Applicant, Minister, specified person (as defined in Section 1 of the Planning Act) or public body that has an interest in the matter has the right to appeal decisions of the Committee of Adjustment. These parties must make written submissions to the Committee prior to the Committee granting or refusing Provisional Consent otherwise, the Ontario Land Tribunal (OLT) may dismiss the appeal.
· Any personal information received in relation to this meeting is collected under the authority s. 28(2) of the Planning Act, R.S.O. 1990, c. P.13, and will be used by the City of Kitchener to process Committee of Adjustment applications.
