COMMITTEE OF ADJUSTMENT - CITY OF KITCHENER 

(Pursuant to the Planning Act, R.S.O. 1990, c.P. 13, as amended,

and Ontario Regulations 197/96 and 200/96, as amended)

TAKE NOTICE THAT the Committee of Adjustment for the City of Kitchener will meet in Council Chambers, 2nd Floor, Kitchener City Hall, 200 King Street West, on TUESDAY, OCTOBER 20, 2026, commencing at 10:00 a.m. for the purpose of hearing the following applications for Minor Variance and/or Consent. Applicants or Agents must attend in support of the application. This is a public meeting. Anyone who has an interest in any of these applications may make oral submission at the meeting or provide a written submission for Committee consideration. Please note, this is a public meeting and will be livestreamed and archived at www.kitchener.ca/watchnow.

APPLICATIONS FOR MINOR VARIANCE AND / OR CONSENT PURSUANT TO THE PLANNING ACT 

A 2026-029 - 326 Wellington Street North (Previously Deferred)

Requesting minor variances to Zoning By-law 2019-051 to permit a setback of 0.3m from the northwesterly side yard abutting 345-349 Louisa Street; to permit a setback of 0.3m from the westerly interior side yard abutting 316 Wellington Street North rather than the minimum required setback of 14m abutting a Residential Zone; and, to permit 15 parking spaces rather than the minimum required 21 parking spaces to facilitate the use of a unit in the building for a vehicle repair and maintenance use.

A 2026-060 - 2333 Kingsway Drive  

Requesting minor variances to Zoning By-law 2019-051 to permit 10 parking spaces rather than the minimum required 12 parking spaces; and, to permit a northerly side yard setback of 1.4m rather than the minimum required 7.5m, to facilitate an office addition to an existing automotive service garage in accordance with Site Plan Application SPF26/045/K.

A 2026-061- 831 Frederick Street

Requesting minor variances to Zoning By-law 2019-051 to permit a reduced private patio area of 4.9 sq.m. rather than the minimum required 11 sq.m; and, to permit an increased building height of 28.5m rather than the maximum permitted 25m, to facilitate the development of an 8-storey multiple dwelling having 87 dwelling units, in accordance with Site Plan Application SPF26/037/F.

A 2026-062 - 56 Everglade Crescent   

Requesting a minor variance to Zoning By-law 2019-051 to permit a rear yard setback of 4.6m rather than the minimum required 7.5m to facilitate the addition of a sunroom at the rear of the existing dwelling. 

A 2026-063 - 29 Bridge Street West

Requesting minor variances to Zoning By-law 2019-051 to permit a deck with a height greater than 1m to be setback 0.7m from the front lot line rather than the minimum required 5.5m; and, to permit a front yard setback of 2.5m rather than the minimum required 5.5m to facilitate the construction of a new front entrance and deck onto the existing dwelling.

A 2026-064 - 104 Blucher Street

Requesting minor variances to Zoning By-law 2019-051 to permit a driveway width of 10.1m rather than the maximum permitted 40% of the lot width or 7.3m to facilitate the provision of 3 parking spaces; to permit an existing driveway to have a width of 1.6m rather than the minimum required 2.6m to recognize the existing driveway and shared right-of-way to the rear yard; and, to permit a front yard setback of 3.1m rather than the minimum required 5.1m to enclose an existing porch.

A 2026-065 - 100 Chicopee Hills Drive

Requesting minor variances to Site Specific Provision (67) of Zoning By-law 2019-051 to permit the minimum and maximum gross floor area for non-residential or non-educational establishment uses to be 1,733.6sq.m. (2.8%) rather than the required 15% (9,115.2sq.m.) to 50% (30,384sq.m.); to permit a street line façade height for a non-residential building of 5.2m rather than the minimum required 7.5m; and, to permit 0 bicycle parking spaces within a secure structure rather than the minimum required 4 bicycle parking spaces (1 space per 500sq.m.) to facilitate the development of a 1 storey commercial plaza having a gross floor area of 1,733.6sq.m in accordance with Site Plan Application SPF26/033/C.

A 2026-067 - 59 Lancaster Street West           

Requesting minor variances to Zoning By-law 2019-051 to permit a deck to be located 3.5m from the rear lot line rather than the minimum required 4m; to permit a parking space to have a width of 2.3m rather than the minimum required 2.6m; and, to permit the front parking space to be located 0m from a street line rather than the minimum required 0.5m to facilitate the conversion of a Single Detached Dwelling to a Duplex.

B 2026-026 - 54 Brubacher Street

Requesting consent to sever a parcel of land having a width of 8.3m on Brubacher Street, a depth of 37.7m and an area of 315.4sq.m. The retained lands will have a width of 8.3m on Brubacher Street, a depth of 37.7m and an area of 315.6sq.m. The consent will facilitate the development of a proposed new Semi-Detached Dwelling Duplex for each half to be dealt with independently.

B 2026-027 to B 2027-029 - 9 Pleasant Avenue

Requesting consent to sever a parcel of land to create 3 new lots to facilitate the development of a townhouse dwelling, having 4 dwelling units, on each of the 4 new lots proposed to be created (for a total of 16 dwelling units), with blanket easements for shared drive aisles and parking, rear yard access, pedestrian movement, parking allocation, building maintenance, waste facilities, private servicing, stormwater management and drainage.

B 2026-030 & A 2026-068 to 069 - 4286, 4288 & 4290 King Street East  

Requesting consent to sever a parcel of land, municipally known as 4288 King Street East, having a width of 31.3m, a depth of 125m and an area of 5,732.1sq.m. The retained land, municipally known as 4286 and 4290 King Street East will have a width of 68.1m, a depth of 77m and an area of 5,352.3sq.m in accordance with the severance sketch submitted with the application. Minor variances to Zoning By-law 2019-051 are also requested on the severed land to permit 96 Class A Bicycle parking spaces rather than the minimum required 176 Bicycle parking spaces; to permit a front yard setback of 2.9m rather than the minimum required 3m; to permit an interior side yard setback of 0m rather than the minimum required 3m; to permit an exterior side yard setback of 5m for storeys 7-12 rather than the minimum required 6m; to permit a building length of 63.5m for storeys 7-12 rather than the maximum permitted 60m; to permit an exterior side yard setback of 5m for storeys 13-18 rather than the minimum required 6m; to permit a floor plate area of 1,600sq.m. rather than the maximum permitted 1,200 sq.m.; and, to permit 1,015.25sq.m. of Non-Residential Gross Floor Area (GFA) rather than the minimum required 1,380sq.m. Minor variances to Zoning By-law 2019-051 are also requested on the retained land, to permit 100 Class A and 6 Class B Bicycle parking spaces rather than the minimum required 191 Class A and 8 Class B Bicycle parking spaces; to permit a front yard setback of 2m rather than the minimum required 3m; to permit an interior side yard setback of 0m rather than the minimum required 3m; to permit a physical separation of 4.5m for storeys 7-12 rather than the minimum required 6m; to permit a physical separation of 4.5m for storeys 13-18 rather than the minimum required 6m; to permit a floor plate area of 1,215sq.m. rather than the maximum permitted 1,200sq.m.; and, to permit 495sq.m. of Non-Residential Gross Floor Area (GFA) rather than the minimum required 1,380 sq.m. The purpose of the requested Minor Variances and Consent is to support financing of a multi-residential development.

·      Only the Applicant, Minister, specified person (as defined in Section 1 of the Planning Act) or public body that has an interest in the matter has the right to appeal decisions of the Committee of Adjustment. These parties must make written submissions to the Committee prior to the Committee granting or refusing Provisional Consent otherwise, the Ontario Land Tribunal (OLT) may dismiss the appeal.
