and Ontario Regulations 197/96 and 200/96, as amended)
TAKE NOTICE THAT the Committee of Adjustment for the City of Kitchener will meet in Council Chambers, 2nd Floor, Kitchener City Hall, 200 King Street West, on TUESDAY, MAY 19, 2026, commencing at 10:00 a.m. for the purpose of hearing the following applications for Minor Variance and/or Consent. Applicants or Agents must attend in support of the application. This is a public meeting. Anyone who has an interest in any of these applications may make oral submission at the meeting or provide a written submission for Committee consideration. Please note, this is a public meeting and will be livestreamed and archived at www.kitchener.ca/watchnow.
APPLICATIONS FOR MINOR VARIANCE AND / OR CONSENT PURSUANT TO THE PLANNING ACT
A 2026-030 - 55 Highbarry Crescent
Requesting minor variances to permit a westerly side yard setback of 0m rather than the minimum required 1.2m; and, a rear yard setback of 6.9m rather than the minimum required 7.5m to facilitate the construction of a sunroom addition at the rear of the existing detached dwelling.
A 2026-031 - 9 Siebert Avenue
Requesting a minor variance to permit steps greater than 0.6m in height to be setback 2m from the street line rather than the minimum required 3m for a residential dwelling having 2 Additional Dwelling Unit (ADUs) (Detached).
A 2026-032 240 Autumn Hill Crescent
Requesting a minor variance not to provide a visual barrier along the lot line abutting a residential zone whereas the By-law requires a visual barrier, to allow for an increase in new gross floor area being added to the lot, to facilitate the development of a 2-storey rear addition to the existing elementary school.
A 2026-033 - 93 Edgehill Drive
Requesting a minor variance to permit a westerly side yard setback of 1.2m rather than the minimum required 3m to facilitate the demolition of an existing attached garage to be replaced with a larger attached garage.
A 2026-034 - 168 Simeon Street
Requesting minor variances to permit a driveway width of 6.6m rather than the maximum permitted 4.6m; to permit a driveway southerly side yard setback of 0m rather than the minimum required 1.2m; and, to permit a southerly side yard setback of 0.2m rather than the minimum required 3m, to recognize the location and configuration of the existing driveway and to facilitate the demolition of an existing attached garage to be replaced with a larger attached garage.
A 2026-035 - 530 Mill Street
Requesting minor variances to permit a front yard setback of 4m rather than the minimum required 4.5m; and, to permit a landscape area of 20% rather than the minimum required 30% to facilitate a second-floor addition to the existing mixed-used building for an Additional Dwelling Unit.
B 2026-006 - 535 Manitou Drive
Requesting consent to sever an irregular parcel of land having a lot width of 57.5m along Manitou Drive, a depth of approximately 169.9m and an area of 9,712sq.m. The retained land will have a width of 300.7m along Homer Watson Blvd, a depth of approximately 57.5m and an area of 23,558sq.m. Both the severed and retained lands are proposed for commercial development. Consent is also requested to create an irregular easement having a width of approximately 12.0m, a length of 203m and area of 2,090sq. m, for the purposes of access and servicing, in favour of the lands proposed to be retained.

- Anyone who has an interest in any of these applications may attend this meeting.
- Only the Applicant, Minister, specified person (as defined in Section 1 of the Planning Act) or public body that has an interest in the matter has the right to appeal decisions of the Committee of Adjustment. These parties must make written submissions to the Committee prior to the Committee granting or refusing Provisional Consent otherwise, the Ontario Land Tribunal (OLT) may dismiss the appeal.
