COMMITTEE OF ADJUSTMENT - CITY OF KITCHENER 

(Pursuant to the Planning Act, R.S.O. 1990, c.P. 13, as amended,

and Ontario Regulations 197/96 and 200/96, as amended)

TAKE NOTICE THAT the Committee of Adjustment for the City of Kitchener will meet in Council Chambers, 2nd Floor, Kitchener City Hall, 200 King Street West, on TUESDAY, JULY 21, 2026, commencing at 10:00 a.m. for the purpose of hearing the following applications for Minor Variance and/or Consent. Applicants or Agents must attend in support of the application. This is a public meeting. Anyone who has an interest in any of these applications may make oral submission at the meeting or provide a written submission for Committee consideration. Please note, this is a public meeting and will be livestreamed and archived at www.kitchener.ca/watchnow.

APPLICATIONS FOR MINOR VARIANCE AND / OR CONSENT PURSUANT TO THE PLANNING ACT 

A 2026-040 - 83 Water Street South     

Requesting a minor variance to permit a front yard setback of 2.1m rather than the minimum required 4.5m to facilitate the construction of a new enlarged 2-storey front porch onto the existing dwelling.

A 2026-041 - 500 Doon Valley Drive

Requesting a minor variance to permit an accessory building to be setback 0.6m from the southerly side lot line rather than the minimum required 7.5m to permit a new Quonset Hut to be constructed at the Doon Valley Golf Course.

A 2026-042 - 14 Holborn Court  

Requesting minor variances to permit a Ground Floor Building Height for any building with a street line façade of 3m along River Road East, rather than a minimum required 4m; to permit the minimum percent of street line façade openings along River Road East of 19% rather than a minimum required 35%; to permit a minimum ground floor street line façade width as a percent of the width of the abutting street line of 42% along Holborn Court rather than the minimum required 50%; and, to permit a Floor Space Ratio (FSR) of 0.95 rather than the minimum required 1.0 to facilitate a multiple residential development having 60 dwelling units in accordance with Site Plan Application SPF26/026/O.

A 2026-043 - 60 Gildner Street

Requesting minor variances to permit a new front porch to be setback 2m from the street line rather than the minimum required 3m; and, to permit an addition to have an easterly side yard setback of 1.2m rather than the minimum required 3.38m to facilitate the reconstruction of a new front porch and a new addition at the side of the existing dwelling.

B 2026-009 - 1020 Ottawa Street North

Requesting consent for a lease in excess of 21 years for a building occupied by 'CIBC', shown as Part 2 on the Plan of Survey, prepared by Van Harten Surveyors and dated May 27, 2026, submitted with the application, on the property municipally known as 1020 Ottawa Street North.

B 2026-010 - 1020 Ottawa Street North

Requesting consent for a lease in excess of 21 years for a building and drive-through occupied by 'Tim Hortons', shown as Part 1 on the Plan of Survey, prepared by Van Harten Surveyors and dated May 27, 2026, submitted with the application, on the property municipally known as 1020 Ottawa Street North.

B 2026-011 & A 2026-044 - Fischer Hallman & Rosenberg

Requesting consent to create an easement over Lot 2 on Registered Plan 1469, having a width of approximately 13.5m, a length of 95m and area of 1,162sq.m., for the purposes of servicing, in favour of the abutting lands (Stage 10, Block 1, 30T-09201). Minor variances are also requested to permit a building height of 21.0m rather than the maximum building height of 13.5m; to permit a primary ground floor façade width of 40% of the length of abutting street lines rather than the minimum ground floor façade width of 50%; and, to add a “Parking lot” as a permitted use for residential purposes whereas a parking lot for residential purposes is not permitted within the zone; to facilitate an affordable housing development.

·         Anyone who has an interest in any of these applications may attend this meeting.

·       Only the Applicant, Minister, specified person (as defined in Section 1 of the Planning Act) or public body that has an interest in the matter has the right to appeal decisions of the Committee of Adjustment. These parties must make written submissions to the Committee prior to the Committee granting or refusing Provisional Consent otherwise, the Ontario Land Tribunal (OLT) may dismiss the appeal.

·  Any personal information received in relation to this meeting is collected under the authority s. 28(2) of the Planning Act, R.S.O. 1990, c. P.13, and will be used by the City of Kitchener to process Committee of Adjustment applications.
