TAKE NOTICE THAT the Committee of Adjustment for the City of Kitchener will meet in Council Chambers, 2nd Floor, Kitchener City Hall, 200 King Street West, on TUESDAY, AUGUST 18, 2026, commencing at 10:00 a.m. for the purpose of hearing the following applications for Minor Variance and/or Consent. Applicants or Agents must attend in support of the application. This is a public meeting. Anyone who has an interest in any of these applications may make oral submission at the meeting or provide a written submission for Committee consideration. Please note, this is a public meeting and will be livestreamed and archived at www.kitchener.ca/watchnow.
APPLICATIONS FOR MINOR VARIANCE AND / OR CONSENT PURSUANT TO THE PLANNING ACT
A 2026-004 - 37 Heiman Street (Deferred from February 2026)
Requesting minor variances to permit a parking area to be located 0.5m from the westerly side lot line rather than the required 1.5m; to permit a lot width of 14.2m rather than the required 19m; and, to permit a southerly side yard setback of 2.3m rather than the required 3m to facilitate the development of a 3-storey multiple dwelling having 6 dwelling units.
A 2026-045 - 181 Queen Street North
Requesting a minor variance to By-law 2019-051 to permit a rear yard setback of 2.2m rather than the minimum required 7.5m to facilitate the construction of a 2-storey rear yard addition with a garage space on the ground floor and a dwelling unit on the 2nd floor.
A 2026-046 - 45 Crestwood Avenue
Requesting a minor variance from By-law 2019-051 to permit a front yard setback of 4.5m rather than the minimum required 5.8m to facilitate replacement of an existing front porch on a detached dwelling with a new mud room and porch.
A 2026-047 - 121 Water Street South
Requesting minor variances to By-law 2019-051 to permit an architectural feature to encroach 0.81m into a required yard rather than the maximum permitted 0.6m; and, to permit a rear yard setback of 1.2m rather than the minimum required 7.5m to facilitate the construction of a new rear yard addition.
A 2026-048 - 60 Westheights Drive
Requesting a minor variance to By-law 2019-051 to permit a parking requirement of 226 parking spaces (1 parking space per 102.3sq.m. of Gross Floor Area (GFA)) rather than the minimum required 252 parking spaces (1 parking space per 92 sq.m of GFA); and to permit a building height of 54m rather than the maximum permitted 14m to facilitate the development of a new 14-storey Residential Care Facility having 384 beds.
B 2025-032 - 776 Rockway Drive (Deferred from February 2026)
Requesting consent to sever a parcel of land having a width of 7.6m on Rockway Drive, a depth of 36.6m, and an area of 278.3sq.m. The retained land will also have a width of 7.6m on Rockway Drive, a depth of 36.6m, and an area of 277.9sq.m. The consent will allow each half of a proposed Semi-Detached Dwelling having 3 Additional Dwelling Units (ADUs) (Attached) to be dealt with independently. The existing dwelling is proposed to be demolished.
B 2025-033 - 104 Brentwood Avenue (Deferred from February 2026)
Requesting consent to sever a parcel of land having a width of 7.6m on Brentwood Avenue, a depth of 36.6m, and an area of 277.9sq.m. The retained land will also have a width of 7.6m on Brentwood Avenue, a depth of 36.6m, and an area of 277.9sq.m. The consent will allow each half of a proposed Semi-Detached Dwelling having 3 Additional Dwelling Units (ADUs) (Attached) to be dealt with independently. The existing dwelling is proposed to be demolished.
B 2026-012 - 45 Second Avenue
Requesting consent to sever a parcel of land having a width of 10m on Second Avenue, a depth of 40.2m, and an area of 404.6sq.m. The retained lands will also have a lot width of 10m on Second Avenue, a depth of 40.2m, and an area of 404.6 sq.m. The consent will facilitate the development of a new Semi-Detached Dwelling, each half having 3 Additional Dwelling Units (ADUs)(Attached).
B 2026-013 - 9 Westgate Walk
Requesting consent to create an easement having a width of 4m, a depth of 9.7m and an area of 36sq.m., over 9 Westgate Walk in favour of the Westmount Golf & Country Club, shown as Part 2 on the Draft Reference Plan submitted with the application, to facilitate a sanitary sewer connection to the golf club.
B 2026-014 & B 2026-015 - 275 Fergus Avenue
Requesting consent (Application B 2026-014) to sever a parcel of land having a width of 7.5m on Fergus Avenue, a depth of 42m and an area of 315.4sq.m. and is proposed for a 2-storey Semi-Detached Dwelling Unit. Consent (Application B 2026-015) is also being requested to sever a parcel of land having a lot width of 7.5m on Fergus Avenue, a depth of 42m and an area of 315.4sq.m. and is proposed for a 2-storey Semi-Detached Dwelling Unit. The retained lands will have a lot width of 11.5m on Fergus Avenue, a depth of 42m and an area of 483.5sq.m. and are proposed for a 2-storey Detached Dwelling.
B 2026-016 & B 2026-017- 180 Ahrens Street West
Requesting consent (B 2026-016, Dwelling 2 on the plan submitted with the application) to sever a parcel of land having a width of 11.5m on Wilhelm Street, a depth of 17.4m, and an area of 211sq.m. and is proposed for a street townhouse dwelling with three Additional Dwelling Units. Consent (B 2026-017, Dwelling 3 on the plan submitted with the application) is also being requested to sever a parcel of land having a width of 10.9m on Wilhelm Street, a depth of 20.6m, and an area of 227sq.m. and is proposed for a street townhouse dwelling with three Additional Dwelling Units. The retained lands will have a width of 13.7m on Ahrens Street West, a depth of 16.2m, and an area of 247sq.m. and is proposed for a street townhouse dwelling with three Additional Dwelling Units.
B 2026-018 to 020 & A 2026-049 - 157 Schweitzer Street
Requesting consent to sever a parcel of land to create 3 new lots for residential use having frontage on Lark Street.

A minor variance to By-law 2019-051 is also being requested for the existing dwelling on the retained land to permit a deck greater than 0.6m in height to be located in an interior side yard and setback 0.6m from the easterly side lot line, to facilitate the proposed severances.
B 2026-021 to 022 & A 2026-050 to 051 - 47 Belleview Avenue
Requesting consent (B 2026-021) to sever a parcel of land having a width of 12.9m on Belleview Avenue, a depth of 42.7m, and an area of 589sq.m., shown as Parts 3 and 4 on the Draft Reference Plan submitted with the application and is proposed to be constructed with 4 new dwelling units, future municipal address 51 Belleview Avenue, consent is also requested over the severed land to have an easement having a width of 3.3m, a depth of 36.2m and an area of 118.8 sq.m. to facilitate shared driveway access. The retained lands will also have a width of 12.9m on Belleview Avenue, a depth of 42.2m and an area of 536sq.m., shown as Parts 1 and 2 on the Draft Reference Plan submitted with the application, consent (B 2026-022) is also being requested to create an easement having a width of 2.76m, a depth of 36.2m and an area of 98.5 sq.m., shown to facilitate shared driveway access. Minor variances are also requested for the severed and retained land to permit a width of 12.9m rather than the minimum required 13.7m to facilitate the construction of a new building having 4 dwelling units.
B2026-023 to 024 & A2026-053 to 055 – 1333 Weber Street East
Consent (B2026-023) is being requested as a Stratified Consent Application to create new parcel of land identified as Tower “B” including two sections of the underground parking levels identified as Parts 4 and 5, located in the underground of the retained land containing Tower “C”, Tower “B’ will having an approximate lot width of 42.6m, a depth of 74.6m, and an area 3,004.7 sq.m. A Stratified Consent Application (B 2026-024) is being requested to create a parcel of land having a width of 53.9m, a depth of 60.3m, and an area of 1707.4 sq.m., including the severance of the underground parking garage. The retained parcel will have an approximate lot width of 49.1m on Fergus Avenue, a width of 82.7m on Weber Street, a depth of 74.4m and an area of 3747.2 sq.m. and is identified for the construction of Tower “C” of the proposed development. The purpose of the consent applications is to support financing of a comprehensively planned, multi-residential development.
A2026-052 - 1333 Weber Street East – Tower A
Requesting relief from the following Sections of Zoning By-law 2019-051, to permit: a multiple dwelling on a lot without a non-residential use; to permit dwelling units on the ground floor and not within a mixed-use building; to permit an interior (northerly) side yard setback of 0m instead of the minimum required 4m; to permit a minimum ground floor building height of 4m instead of the minimum required 4.5m; to permit a maximum number of storeys of 15 instead of the maximum permitted 10 storeys; to permit a minimum street line stepback for a tall building of 0m instead of the minimum required 3m; to permit a minimum ground floor street line facade width as a percent of the width of the abutting street line of 43% instead of the minimum required 50%; to permit a minimum percent street line facade openings of 39% instead of the minimum required 50%; and, to permit a minimum percent of non-residential gross floor area of 0% instead of the minimum required 20%.
A2026-053 - 1333 Weber Street East – Tower B
Requesting relief from the following Sections of Zoning By-law 2019-051, to permit: to permit a multiple dwelling on a lot without a non-residential use; to permit dwelling units on the ground floor and not within a mixed-use building; to permit a minimum rear yard setback of 4.7m instead of the minimum required 7.5m; to permit an interior side yard setback of 0m instead of the minimum required 4m; to permit a minimum ground floor building height of 4.2m instead of the minimum required 4.5m; to permit a maximum number of storeys of 15 instead of the maximum permitted 10 storeys; to permit a minimum ground floor street line facade width as a percent of the width of the abutting street line of 45% instead of the minimum required 50%; to permit a minimum percent street line facade openings of 41% instead of the minimum required 50%; to permit a minimum percent of non-residential gross floor area of 0% instead of the minimum required 20%; to permit a minimum parking requirement of 152 parking spaces inclusive of visitor parking (0.78 parking spaces per dwelling unit), instead of the minimum required 193 parking spaces per dwelling unit (0.9 parking spaces and 0.1 visitor parking spaces per dwelling unit); to permit a total of 62 Class A Bicycle parking spaces instead of the minimum required 103 Bicycling parking spaces; and, to permit a maximum Floor Space Ratio (FSR) of 5.42 instead of the maximum permitted 4.0.
A2026-054 - 1333 Weber Street East – Tower C
Requesting relief from the following Sections of Zoning By-law 2019-051, to permit: to permit an interior side yard setback of 0m instead of the minimum required 4m; to permit a maximum number of storeys of 12 instead of the maximum permitted 10 storeys; to permit a minimum street line stepback for a tall building of 0m instead of the minimum required 3m; to permit a minimum ground floor street line facade width as a percent of the width of the abutting street line of 47% instead of the minimum required 50% (along Weber Street); to permit a minimum ground floor street line facade width as a percent of the width of the abutting street line of 37% instead of the minimum required 50% (along Fergus Avenue); to permit a minimum percent street line facade openings of 41% instead of the minimum required 50% (for Weber Street); to permit a minimum percent street line facade openings of 35% instead of the minimum required 50% (for Fergus Avenue); to permit a minimum parking requirement of 128 parking spaces inclusive of visitor and commercial parking (0.8 parking spaces per dwelling unit), instead of the minimum required 163 parking spaces per dwelling unit (0.9 parking spaces and 0.1 visitor parking spaces per dwelling unit and 1 parking space per 35 sq.m. of Gross Floor Area (GFA)); and, to permit a total of 65 Class A Bicycle parking spaces instead of the minimum required 89 Bicycling parking spaces.
A2026-055 - 1333 Weber Street East – Tower D
Requesting relief from the following Sections of Zoning By-law 2019-051, to permit: to permit a minimum rear yard setback of 0m instead of the minimum required 7.5m; to permit an easterly interior side yard setback of 0m instead of the minimum required 4m; to permit a westerly interior side yard setback of 3.8m instead of the minimum required 4m; to permit a maximum number of storeys of 12 instead of the maximum permitted 10 storeys; to permit a minimum street line stepback for a tall building of 0m instead of the minimum required 3m; to permit a minimum ground floor street line facade width as a percent of the width of the abutting street line of 41% instead of the minimum required 50%; to permit a minimum percent street line facade openings of 40% instead of the minimum required 50%; to permit a minimum parking requirement of 60 parking spaces inclusive of visitor and commercial parking (0.63 parking spaces per dwelling unit), instead of the minimum required 104 parking spaces per dwelling unit (0.9 parking spaces and 0.1 visitor parking spaces per dwelling unit and 1 parking space per 35 sq.m. of Gross Floor Area (GFA)); and, to permit a total of 16 Class A Bicycle parking spaces instead of the minimum required 56 Bicycling parking spaces; to permit a maximum Floor Space Ratio (FSR) of 6.1 instead of the maximum permitted 4.0.

- Only the Applicant, Minister, specified person (as defined in Section 1 of the Planning Act) or public body that has an interest in the matter has the right to appeal decisions of the Committee of Adjustment. These parties must make written submissions to the Committee prior to the Committee granting or refusing Provisional Consent otherwise, the Ontario Land Tribunal (OLT) may dismiss the appeal.
