TAKE NOTICE THAT the Committee of Adjustment for the City of Kitchener will meet electronically TUESDAY, APRIL 19, 2022, commencing at 10:00 a.m. for the purpose of hearing the following applications for Minor Variance and/or Consent. Beginning March 1, 2022, the City of Kitchener has aligned with provincial changes to COVID-19 restrictions and City Hall is now open for in person services, but appointments are still being encouraged. The City remains committed to safety of our patrons and staff and continue to facilitate electronic meeting participation for members of the public. Applicants or Agents must register to participate electronically in support of the application. This is a public meeting, anyone having an interest in any of these applications may register to participate electronically as a delegation or submit comments for Committee consideration. APPLICATIONS FOR MINOR VARIANCE AND / OR CONSENT PURSUANT TO THE PLANNING ACT
A 2022-032 – 110 Florence Avenue
Requesting a minor variance to the Zoning By-law to allow for the construction of a new covered stair and landing at the front entrance of the existing single detached dwelling having a front yard setback of 2.5m rather than the required 4.5m.
A 2022-033 – 52 Woodland Avenue
Requesting a minor variance to the Zoning By-law to allow for an existing accessory building (detached garage) to a single detached dwelling to be converted into an additional dwelling unit having a lot width of 12.1m rather than the required 13.1m; a north-westerly side yard setback of 0.4m rather than the required 0.6m; and, a driveway and parking space width of 2.2m rather than the required 2.6m.
A 2022-035 – 99 Kehl Street
Requesting a minor variance to the Zoning By-law to allow for an existing noncompliant accessory building (detached garage) to a single detached dwelling to be converted into a heated studio to support a home occupation having a westerly side yard setback of 0.2m rather than the required 0.6m; and, an easterly side yard setback of 0.4m rather than the required 1.2m to allow for the construction of exterior stairs to a proposed 2-storey addition at the rear of the existing dwelling.
A 2022-036 – 235 Heiman Street
Requesting a minor variance to the Zoning By-law to allow for a westerly side yard setback of 1.2m rather than the required 1.5m to support the conversion of a duplex dwelling into a 5-unit multiple dwelling building.
A 2022-037 – 234-240 Frederick Street
Requesting a minor variance to the Zoning By-law to allow for the existing office building (234 Frederick Street) and triplex dwelling (240 Frederick Street) to be retained and the existing accessory building be demolished to permit the construction of a 4-storey, 32-unit apartment building located north of the residential building located at 240 Frederick Street and fronting onto Gordon Avenue having a rear yard setback of 5.2m rather than the required 7.5m; a building height of 14.2m rather than the required 12.2m; a parking rate of 1 spaces/residential unit (36 spaces, inclusive of visitor parking) rather than the required 1.25 spaces/unit (44 spaces); a parking rate of 1 spaces/65sq.m. of office space (7 spaces) rather than the required 1 spaces/33sq.m. (14 spaces); and, the shared use of up to 50% of the office parking stalls for visitor parking purposes.
A 2022-038 – 71 Tradewinds Place
Requesting a minor variance to the Zoning By-law to allow for the construction of a covered patio in the rear yard of a single detached dwelling having a rear yard setback of 5.9m rather than the required 7.5m.
A 2022-039 – 3241-3247 King Street East & 108 Cameo Drive
Requesting a minor variance to the Zoning By-law to allow for the demolition of an existing single detached dwelling (108 Cameo Drive) and the construction of 3 residential towers fronting onto King Street East and Cameo Drive having a front yard setback of 4m on King Street East rather than the required 39m; an easterly side yard setback of 1.5m rather than the required 6m; a westerly side yard setback of 4.5m rather than the required 6m; a rear yard setback of 3m from Cameo Drive rather than the required 7.5m; a parking rate of 0.94 spaces/residential unit (894 spaces) rather than the required 1.5 spaces/unit (1422 spaces); a visitor parking ratio of 6% (85 spaces) rather than the required 20% (284 spaces) of parking spaces for multiple dwellings of more than 60 units; and, to permit a maximum of 488 units/ha rather than the required 100 units/ha.
B 2022-028 – 425 Bingemans Centre Drive
Requesting consent to sever a parcel of land from 425 Bingemans Centre Drive, shown as Part 1 on the Severance Plan submitted in support of the application, having a lot area of 10.9 hectares, and frontage on Shirley Drive North and Bingemans Centre Drive. The retained lands, shown as Parts 2 and 3 on the Severance Plan submitted with the application, will have an area of 50.2 hectares, with Part 2 having frontage on Bingemans Centre Drive. To sever and convey a parcel of employment lands for the creation of a future multi-tenant industrial building and accessory office.
B 2022-029 – 96 Third Avenue
Requesting consent to sever a parcel of land having a width of 7.8m, a depth of 39.8m and an area of 312sq.m. The retained parcel of land having a width of 7.8m, a depth of 39.8m and an area of 312sq.m. The existing dwelling is to be demolished and a semi-detached duplex dwelling is proposed.
B 2022-030 – 50 Florence Avenue
Requesting consent to sever a parcel of land having a width of 15m, a depth of 25.6m and an area of 386.4sq.m. The retained parcel of land having a width of 10.6m, a depth of 25.6m and an area of 272.2sq.m. The existing dwelling is to be demolished and two single detached dwellings are proposed.

- a person or public body that files an appeal of a consent decision of the Committee of Adjustment must make written submissions to the Committee before the Committee gives or refuses to give a Provisional Consent otherwise the Ontario Land Tribunal (OLT) may dismiss the appeal.
- any personal information received in relation to this meeting is collected under the authority s. 28(2) of the Planning Act, R.S.O. 1990, c. P.13, and will be used by the City of Kitchener to process Committee of Adjustment applications.
