Who or What is Committee of Adjustment?
5 Kitchener professionals make up the Committee of Adjustment. A panel of three members is present at each hearing and the Municipal Act requires the Committee to make its decision in public.

Basic information on how the Committee works

The Planning Act of Ontario gives the Committee of Adjustment the authority to:

• grant Minor Variances from the City’s Zoning By-law;
• allow changes to legal non-conforming uses which the current zoning does not permit;
• give Consent for land severance to divide a parcel of land into more than one lot or as lot additions to abutting properties;
• give Consent to mortgages, partial discharge of mortgages and validation of title;
• give Consent to leases over 21 years, quit claims, easements and rights-of-way

The City of Kitchener Municipal Code (Chapters 630 and 680) gives the Committee of Adjustment authority to:

• grant Minor Variances from the City’s Fence By-law (c.630 );
• grant Minor Variances from the City’s Sign By-law (c.680 ).

Fence and sign variance approvals are subject to ratification by City Council.

Application Form and 2010 Fees

• obtain form from the Development & Technical Services Department, City Hall, 6th Floor, 200 King Street West, Kitchener
• Minor Variances - 1 original plus 13 copies of the application form and 14 detailed plans are required to be submitted - application fee is $940.50
• Consents/Validation of Title - 1 original plus 15 copies of the application form and 16 detailed plans are required to be submitted - application fee is $1118.75 per lot or block to be created
• Change of Conditions to a Provisional Consent - 1 original plus 15 copies of the application form and 16 copies of the original consent decision are required to be submitted - application fee is $562.25
• Deferral Fee is $316.25
• Certificate of Official is $138.00
