Who or What is Committee of Adjustment?
5 Kitchener professionals make up the Committee of Adjustment. A panel of three members is present at each hearing and the Municipal Act requires the Committee to make its decision in public.

The Planning Act of Ontario gives the Committee of Adjustment the authority to:

  • grant Minor Variances from the City’s Zoning By-law;
  • allow changes to legal non-conforming uses which the current zoning does not permit;
  • give Consent for land severance to divide a parcel of land into more than one lot or as lot additions to abutting properties;
  • give Consent to mortgages, partial discharge of mortgages and validation of title;
  • give Consent to leases over 21 years, quit claims, easements and rights-of-way

The City of Kitchener Municipal Code (Chapters 630 and 680) gives the Committee of Adjustment authority to:

  • grant Minor Variances from the City’s Fence By-law (c.630 pdf logo);
  • grant Minor Variances from the City’s Sign By-law (c.680 pdf logo).

Fence and sign variance approvals are subject to ratification by City Council.
